Protecting Your Privacy

Notice of Privacy Practices

This Notice describes how your protected health information may be used and disclosed, your rights regarding that information, and our legal responsibilities under the Health Insurance Portability and Accountability Act (HIPAA). Please read this Notice carefully.

Effective Date: July 2026

Who This Notice Applies To

This Notice applies to Phoenix Rising Therapy, LLC and all its personnel, including clinical staff, administrative employees, and business associates who may have access to your health information. We are required by law to maintain the privacy of your health information and to provide you with this Notice of our legal duties and privacy practices.

Our Legal Duties

We are required by law to maintain the privacy and security of your protected health information (PHI). We will let you know promptly if a breach occurs that may have compromised the privacy or security of your information. We must follow the duties and privacy practices described in this notice and give you a copy of it. We will not use or share your information other than as described here unless you tell us we can in writing.

How Your Information May Be Used

The following categories describe different ways that we use and disclose your health information. For each category, we will explain what we mean and give some examples.

Treatment

We can use your health information and share it with other professionals who are treating you. For example, your therapist may consult with a psychiatrist or other specialist regarding your clinical progress to ensure coordinated care.

Payment

We can use and share your health information to bill and get payment from health plans or other entities. For example, we give information about your diagnosis and the services provided to your health insurance company so it will pay for your treatment.

Health Care Operations

We can use and share your health information to run our practice, improve your care, and contact you when necessary. For example, we use health information in our practice to manage your treatment and services or to evaluate the performance of our staff.

Other Disclosures Permitted or Required by Law

We are allowed or required to share your information in other ways—usually in ways that contribute to the public good, such as public health and research. We have to meet many conditions in the law before we can share your information for these purposes. These include: helping with public health and safety issues, reporting child or elder abuse/neglect, preventing or reducing a serious threat to anyone's health or safety, complying with workers' compensation laws, and responding to lawsuits or legal actions.

Uses Requiring Your Authorization

In other situations, we will ask for your written authorization before using or disclosing any of your PHI. A written authorization is required for most uses and disclosures of psychotherapy notes, for most marketing purposes, and for any disclosure which constitutes a sale of health information. If you choose to sign an authorization to disclose your information, you can later revoke it in writing to stop any future uses and disclosures.

Psychotherapy Notes

Psychotherapy notes are notes your therapist takes during your sessions that are kept separate from the rest of your medical record. These notes generally receive more protection than other types of health information. Most uses and disclosures of psychotherapy notes require your written authorization, except for our use for your treatment or for certain other legal requirements.

Privacy for Restorative Services

Regardless of whether you are receiving clinical psychotherapy or engaging in non-clinical restoration experiences (such as Sound Immersion or Vibroacoustic Therapy), Phoenix Rising Therapy maintains the same high standards of privacy and confidentiality for your records across all our departments.

Your Rights

When it comes to your health information, you have certain rights. You have the right to: get a copy of your paper or electronic medical record; correct your paper or electronic medical record if you feel it is incorrect; request confidential communication; ask us to limit the information we share; get a list of those with whom we've shared your information; get a copy of this privacy notice; and choose someone to act for you.

How to Exercise Your Rights

To exercise any of your rights listed above, please submit a written request to our Privacy Official at the contact information provided at the end of this Notice. We will provide a copy or a summary of your health information, usually within 30 days of your request. We may charge a reasonable, cost-based fee.

Complaints

If you feel we have violated your privacy rights, you can complain by contacting our Privacy Official using the information below. You can also file a complaint with the U.S. Department of Health and Human Services Office for Civil Rights. We will not retaliate against you for filing a complaint.

Third-Party Services

Phoenix Rising may use third-party business associates for certain services such as billing, practice management, or secure communication platforms. These third parties are legally and contractually required to maintain the same strict privacy and security standards as our practice.

Changes to This Notice

We can change the terms of this notice, and the changes will apply to all information we have about you. The new notice will be available upon request, in our office, and on our website.
